Physician payment patch in jobs bill Congress hasn't completely forgotten about physicians now that Washington has turned its major focus from healthcare to job creation. In fact, tucked into the current jobs bill is a seven-month extension of the Medicare payment patch that's set to expire in March. The bill also seeks to change the definition of "hospital-based physician" in order to make more physicians who practice in hospital-owned outpatient centers eligible for incentive payments under the American Recovery and Reinvestment Act. The challenge of comparative effectiveness research The Wall Street Journal has an interesting article about the challenges of getting physicians to incorporate comparative effectiveness research. It looks at a 2007 study that found stent procedures were no more clinically effective than a cocktail of generic drugs when treating patients with chronic chest pain. Although stent usage dropped initially after the study, levels have since grown and it is still a widely popular procedure. CER is supposed to work by just providing physicians with information and letting them change their own behaviors, but some think that the effectiveness research will have to be tied to reimbursement to be truly effective. Nurse Anesthetists Battle Overlooks Rural Doctor Shortage My colleague Cheryl Clark tackles the controversy over CRNA independence in her column this week. A lot of the physicians who are fighting against allowing CRNAs to administer anesthesia without physician supervision are ignoring the serious problem of physician shortages in rural areas. For rural hospitals, CRNAs may be the only option for anesthesia, unless they pay exorbitantly to bring in a physician from another area. It would be irresponsible and possibly harmful to patients to rule out a viable care option when shortages are limiting access. [Read

Illinois top court strikes down medical malpractice caps The Illinois Supreme Court struck down the state's medical malpractice law, saying it violates separation of powers by allowing lawmakers to interfere with a judge's ability to reduce verdicts, the Chicago Tribune reports. This is why a federal cap on malpractice damages would be so hard to enforce, even if it could pass Congress. These cases are handled at a state level and state courts would likely challenge the constitutionality of a federal cap. [Read
