Hospitals are putting more patients into "observation" status for longer than 48 hours instead admitting them, in part out of fear of what happened to one California hospital this month, the American Hospital Association says.

The Christ Hospital, which agreed in May to pay $108 million to resolve a whistleblower lawsuit alleging illegal kickbacks, has signed a corporate integrity agreement with the federal government that allows the Cincinnati hospital to continue to participate in Medicare and other federal healthcare programs.

Starting in just 24 months, hospitals falling under the Inpatient Prospective Payment System will automatically see their reimbursements drop. Some hospitals will earn some or all that money back, if they score well on selected outcome measures. Others will see their reimbursements shrink for the year.

Under the Affordable Care Act, the Centers for Medicare & Medicaid Services must post information on quality, performance, and patient experience for physicians enrolled in the Medicare program on a public website. And it must make the data useful for providers to improve upon that care. But it doesn't have much time.
